Welcome to dmnshd.gg, a WebXR browser-based gaming platform operated by dmnshd, LLC, a Delaware limited liability company registered at 1111b South Governors Ave, STE 92908, Dover, DE 19904, United States.

By using this platform, you agree to these terms. If you don't agree, please don't use the platform. When we say "we," "us," or "our," we mean dmnshd, LLC.

1. Eligibility

You must be at least 13 years old to create an account or use dmnshd.gg. By registering, you confirm that you meet this age requirement.

For users in the EU/EEA: Some EU/EEA member states set the age of digital consent higher than 13 (up to 16). If you are located in a jurisdiction where the age of digital consent is higher than 13, you must meet that higher age requirement to create an account, or have verifiable parental or guardian consent. By registering, you confirm that you meet the applicable age requirement in your jurisdiction.

To make purchases on dmnshd.gg (including buying Tokens), you must be at least 18 years old or have the consent of a parent or legal guardian. By completing a purchase, you represent that you meet this requirement.

2. Your Account

  • You're responsible for keeping your login credentials secure.
  • You're responsible for all activity under your account, including purchases.
  • Don't share your account with others.
  • Provide accurate information when registering (via email/password, Google, or Discord).
  • Let us know immediately if you suspect unauthorized access to your account.

3. User Conduct

When using dmnshd.gg, you agree to:

  • Not cheat or exploit games in ways that undermine fair play (e.g., manipulating leaderboard scores, exploiting save game systems).
  • Not harass other users through comments, ratings, or any other means.
  • Not abuse platform features (e.g., spamming comments, mass-downvoting, attempting to access other users' data).
  • Not attempt to circumvent platform security or access systems you're not authorized to use.
  • Not exploit the Token or IAP system (e.g., attempting to generate Tokens fraudulently, abusing refund processes, or using chargebacks to retain purchased items).

4. Tokens & Virtual Currency

dmnshd.gg offers a virtual currency called "Tokens" that can be purchased with real money and used within the platform.

What Tokens are. Tokens are a digital virtual currency with no real-world monetary value. They are a limited license to access certain digital content and features on dmnshd.gg, not a stored-value product, financial instrument, or currency of any kind.

What you can do with Tokens. Tokens may be used to purchase in-game items, cosmetics, or other virtual content within games on the platform, and to tip or support the dmnshd.gg team.

No cash value. Tokens cannot be redeemed, refunded, transferred, or exchanged for real money, credit, or any other form of compensation. Tokens have no equivalent cash value.

Non-transferable. Tokens are tied to your account and cannot be transferred, traded, or sold to other users. Any attempt to do so is a violation of these terms.

No interest or earnings. Tokens do not accrue interest or generate earnings of any kind.

Price and availability. We reserve the right to change the pricing, availability, or functionality of Tokens at any time.

Token system discontinuation. If we decide to discontinue the Token system entirely, we will provide at least 90 days' advance notice via email and/or platform notification. During this notice period, you will have the opportunity to spend your remaining Token balance. For any Tokens purchased within the 90 days immediately preceding the discontinuation announcement that remain unspent at the end of the notice period, you may request a refund by contacting legal@dmnshd.gg. Refund amounts will be calculated based on the original purchase price of the unspent Tokens.

Token balance. We may set limits on the number of Tokens you can hold or purchase within a given period. Your Token balance is visible in your account.

EU/EEA Right of Withdrawal Waiver

For users in the EU/EEA: Under the EU Consumer Rights Directive (Directive 2011/83/EU), you normally have a 14-day right to withdraw from online purchases. However, by confirming a Token purchase, you:

1. Acknowledge that the Tokens (digital content) will be delivered to your account immediately upon purchase;

2. Expressly consent to the immediate delivery of the digital content; and

3. Acknowledge that you lose your 14-day right of withdrawal once the Tokens are credited to your account.

This waiver is presented and confirmed at the point of purchase before payment is processed, in accordance with Article 16(m) of the Consumer Rights Directive.

5. Purchases & Payments

Payment processor. All purchases on dmnshd.gg are processed by Paddle (Paddle.com Market Limited), which acts as the Merchant of Record for all transactions. When you make a purchase, your financial relationship for that transaction is with Paddle, not dmnshd.gg.

Pricing and taxes. Prices for Tokens are displayed at checkout and may vary by region. Paddle handles all applicable taxes (including VAT, sales tax, and GST) on your behalf. The final price shown at checkout includes all applicable taxes.

Payment methods. Available payment methods are determined by Paddle and may include credit/debit cards, PayPal, and other regional methods. We do not store your payment information directly.

Authorization. By completing a purchase, you authorize Paddle to charge the selected payment method for the total amount displayed at checkout.

Failed transactions. If a transaction fails or is declined, no Tokens will be credited to your account. If Tokens are credited in error, we reserve the right to deduct them from your balance.

6. Refund Policy

14-Day Cancellation Right

Because Paddle is the Merchant of Record for all purchases on dmnshd.gg, Paddle's Buyer Terms apply to your transactions. Under those terms, you have the right to cancel a purchase and request a refund within 14 days of the transaction date, without giving any reason.

To request a refund within this 14-day window:

  • Contact Paddle's support team directly at [paddle.net](https://paddle.net) or help@paddle.com; or
  • Contact us at legal@dmnshd.gg and we will process the request through Paddle.

Refunds are returned to the original payment method and may take up to 10 business days to process depending on your payment provider.

Digital Content Exception

Under Paddle's Buyer Terms and applicable consumer protection law, the 14-day cancellation right does not apply to digital content that has already been delivered and accessed. Because Tokens are delivered to your account immediately upon purchase:

  • By completing a Token purchase, you acknowledge that the digital content (Tokens) is delivered immediately;
  • If you have already spent some or all of the Tokens, those spent Tokens and any virtual items obtained with them are non-refundable;
  • If Tokens remain unspent and you request a refund within the 14-day window, we will process a refund for the unspent portion.

For users in the EU/EEA: This is consistent with the EU Right of Withdrawal waiver described in Section 4, where you expressly consent to immediate delivery and acknowledge the loss of your withdrawal right once Tokens are credited. However, if you believe the waiver was not properly presented at checkout or you did not give informed consent, you may still exercise your 14-day cancellation right by contacting Paddle or us.

Refunds Beyond 14 Days

Refund requests submitted after the 14-day window may be considered on a case-by-case basis in the following circumstances:

  • Unauthorized transactions;
  • Technical errors resulting in incorrect charges or non-delivery of Tokens;
  • Duplicate purchases caused by platform errors.

These requests should be directed to legal@dmnshd.gg.

Paddle's Policies

Because Paddle acts as the Merchant of Record, all refund processing is ultimately subject to Paddle's refund policies and procedures. Where Paddle's policies provide you with greater protection than ours, Paddle's policies apply. You may also contact Paddle directly at [paddle.net](https://paddle.net) regarding any refund or billing inquiry.

Chargebacks

Filing a chargeback or payment dispute for a legitimate Token purchase — where you have not first attempted resolution through the refund process described above — is a violation of these terms and may result in suspension or termination of your account.

Statutory Consumer Rights

For users in the EU/EEA and UK: Nothing in this refund policy limits any statutory refund or consumer rights you may have under applicable EU/EEA or UK law. Where statutory rights provide greater protection, those rights take precedence.

7. Intellectual Property

All games, content, and media published on dmnshd.gg are owned by dmnshd, LLC or its operators. The dmnshd.gg name, logo, platform design, Token system, and all game content are our property. You may not copy, redistribute, or create derivative works from any platform content without our written permission.

8. User-Generated Content

Comments, ratings, and other user-generated content you post:

  • Must not violate these terms or any applicable laws.
  • May be removed if they violate our guidelines.
  • You retain ownership of, but grant us a license to display on the platform.

9. File Uploads & Storage

  • Avatar images (JPEG, PNG, WebP, GIF) are limited to 5MB.
  • Files are stored on our servers. We do not use third-party cloud storage.
  • We make reasonable efforts to preserve your data but do not guarantee against data loss.

10. Termination & Suspension

We may suspend or terminate your account if you:

  • Violate these terms.
  • Engage in harassment or abuse.
  • Attempt to compromise platform security.
  • Abuse the Token or payment system (including fraudulent purchases, chargebacks, or exploitation of refund processes).

Voluntary account deletion. You may delete your account at any time. Deleting your account removes all your associated data (saves, scores, achievements, comments, and ratings) via cascade deletion.

Token balance warning on deletion. Before your account deletion is finalized, you will be clearly warned if you have a remaining Token balance. You will have the opportunity to cancel the deletion and spend your remaining Tokens first. Once deletion is confirmed and processed, any remaining Token balance is permanently forfeited with no refund.

Effect on Tokens — involuntary termination. If your account is terminated or suspended by us for a violation of these terms, any remaining Token balance is forfeited with no refund.

11. Disclaimers

  • dmnshd.gg is provided "as is" without warranties of any kind.
  • This is an indie project. We do our best, but we can't guarantee 100% uptime, data preservation, or uninterrupted service.
  • We do not guarantee the continued availability of the Token system, any specific virtual items, or any particular in-game content available for purchase.

For users in the EU/EEA and UK: These disclaimers do not affect your statutory rights as a consumer under applicable EU/EEA or UK law. Where mandatory consumer protection laws provide you with guarantees or rights that cannot be excluded or limited, those rights remain fully in effect. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.

12. Limitation of Liability

To the maximum extent permitted by law, dmnshd, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to losses related to Token purchases, virtual items, or in-game content.

Our total liability for any claim related to the platform is limited to the amount you've actually paid to us in the 12 months preceding the claim, if any.

For users in the EU/EEA and UK: The limitations in this section do not apply to the extent they would conflict with mandatory consumer protection laws in your jurisdiction. In particular, nothing in these terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation;
  • Any other liability that cannot be excluded or limited under applicable mandatory law.

13. Dispute Resolution

We want to resolve disputes fairly and efficiently. If you have a concern, here's how it works:

Step 1: Informal Resolution

Before filing any formal claim, you agree to contact us at legal@dmnshd.gg and attempt to resolve the dispute in good faith. We'll have 30 days from the date of your initial contact to work things out.

Step 2: Binding Arbitration

If we can't resolve the dispute informally within 30 days, either party may initiate binding arbitration administered under the rules of the American Arbitration Association (AAA) then in effect. Arbitration will be conducted on an individual basis in the English language.

Class Action Waiver

You agree to resolve disputes with us on an individual basis only. You waive the right to participate in any class action, class arbitration, or representative proceeding against dmnshd, LLC.

Small Claims Exception

Either party may bring an individual claim in small claims court if the claim falls within that court's jurisdictional limits.

For users in the EU/EEA and UK

The arbitration clause and class action waiver in this section do not apply to users where such provisions are prohibited or unenforceable under mandatory local consumer protection law. If you are a consumer in the EU/EEA or UK, you retain the right to bring claims in the courts of your country of residence, and nothing in this section limits your right to seek remedies available under mandatory local law, including through alternative dispute resolution bodies recognized in your jurisdiction.

14. Accessibility

We are committed to making dmnshd.gg accessible. We strive to meet WCAG 2.1 Level AA standards and are aware of obligations under the European Accessibility Act where applicable.

This is an ongoing effort — if you encounter an accessibility barrier or have suggestions for improvement, please contact us at legal@dmnshd.gg and we will work to address the issue.

15. EU/EEA & UK Consumer Rights Savings Clause

Nothing in these Terms of Service is intended to limit or exclude any mandatory rights you have as a consumer under applicable EU/EEA or UK law, including but not limited to:

  • The EU Consumer Rights Directive (2011/83/EU);
  • The Unfair Contract Terms Directive (93/13/EEC);
  • National implementations of EU consumer protection law;
  • The UK Consumer Rights Act 2015.

Where any provision of these terms conflicts with your mandatory statutory rights, your statutory rights prevail.

16. Changes to These Terms

We may update these terms from time to time. When we do, we'll update the version number and effective date at the top. If changes materially affect your rights regarding Tokens or purchases, we will make reasonable efforts to notify you (e.g., via email or a platform notification). Continued use of the platform after changes constitutes acceptance of the new terms.

17. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States.

For users in the EU/EEA and UK: This choice of law does not deprive you of the protection of mandatory consumer protection provisions of the laws of your country of residence. Any disputes may be brought in the courts of your country of residence where permitted by applicable law.
